1. Service Overview

TrackSorter is a SaaS (Software as a Service) operated by SPYK SAS, a French company, enabling automatic sorting of motorsport photos and videos using artificial intelligence. The service is accessible via our website www.tracksorter.com and our desktop application available on Windows and Mac.

By using TrackSorter, you agree to these Terms of Service. If you do not accept these terms, please do not use our service.

2. Service Description

2.1 How it Works

TrackSorter analyzes thumbnails of your motorsport photos to automatically sort them according to various criteria (vehicle, driver, number, etc.). Important: only thumbnails are sent to our servers for analysis. Your original photos remain stored on your computer and are never transferred to our servers.

2.2 Desktop Application

Our desktop application for Windows and Mac allows you to select your photo folders, generate thumbnails locally, and send them for analysis. The application also manages the sorting of your original files on your computer according to the analysis results.

3. Credit System

3.1 How Credits Work

TrackSorter operates on a credit system. 1 credit = 1 vehicle detection. A photo or video may contain multiple vehicles and therefore consume multiple credits depending on your analysis settings.

Credits are debited at the time of analysis. Credits do not expire as long as your account remains active.

3.2 Non-refundable

Credits and subscriptions are non-refundable. In case of analysis failure attributable to our service, credits may be re-credited to your account.

4. Subscriptions and Pricing

4.1 Subscription Plans

TrackSorter offers several subscription tiers:

• Free : Limited access to discover the service
• Standard : For occasional photographers
• Premium : For regular photographers
• Agency : For professionals and agencies

Subscriptions are available in monthly or annual plans. Current prices are displayed on our pricing page.

4.2 Payment

Payments are made by credit card through our secure payment provider Stancer. All payments are secure and PCI-DSS compliant.

4.3 Renewal

There is no automatic renewal. At the end of your subscription period, you freely choose whether to renew or not. If you do not renew, your account returns to the free version and you keep your remaining credits.

4.4 Promo Codes and Referrals

TrackSorter offers a referral program and promotional codes. These benefits are subject to specific conditions and cannot be combined unless otherwise stated. TrackSorter reserves the right to modify or discontinue these programs at any time.

5. User Account

5.1 Account Creation

To use TrackSorter, you must create an account by providing a valid email address and password. You are responsible for maintaining the confidentiality of your credentials and for all activities that occur under your account.

5.2 Accuracy of Information

You agree to provide accurate and up-to-date information. TrackSorter reserves the right to suspend or delete any account containing obviously false information.

6. Intellectual Property

6.1 Your Content

You retain all intellectual property rights to your photos and videos. By using TrackSorter, you grant us only a limited and temporary license to process thumbnails of your images for analysis and sorting purposes. This license ends as soon as the analysis is complete and thumbnails are deleted from our servers.

6.2 Our Service

TrackSorter, its logo, interface, algorithms, and source code are protected by intellectual property rights. Any unauthorized reproduction, modification, or use is prohibited.

7. Acceptable Use

You agree not to:

• Use the service for illegal or unauthorized purposes
• Attempt to bypass security measures or service limitations
• Send illegal, offensive content or content that infringes third-party rights
• Resell or redistribute the service without authorization
• Use automated means to access the service abusively
• Share your login credentials with third parties

8. Liability and Warranties

8.1 Service Availability

TrackSorter strives to keep the service available 24/7. However, we do not guarantee uninterrupted availability. Interruptions may occur for maintenance, updates, or due to circumstances beyond our control.

8.2 Analysis Accuracy

Our artificial intelligence system provides sorting results to the best of its abilities. We do not guarantee 100% accuracy in image recognition and sorting. It is recommended to verify results, especially for critical professional uses.

8.3 Limitation of Liability

To the extent permitted by French law, TrackSorter shall not be liable for indirect damages, data loss, loss of profits, or business interruptions resulting from the use or inability to use the service. Our total liability is limited to the amount paid by the user during the last 12 months.

8.4 Your Responsibilities

You are responsible for backing up your original photos. TrackSorter does not store your original photos and cannot be held responsible for their loss. You are also responsible for ensuring that you have the necessary rights to the content you analyze.

9. Termination

9.1 Termination by User

Termination is done by not renewing your subscription. At the end of your subscription period, if you do not renew, your account returns to the free version. You can also request complete deletion of your account via our contact form. Remaining credits are non-refundable.

9.2 Termination by TrackSorter

TrackSorter reserves the right to suspend or terminate your account in case of violation of these Terms, fraudulent use, or prolonged inactivity. In case of termination for serious breach, remaining credits will be forfeited without refund.

9.3 Consequences of Termination

Upon termination, your access to the service will be deactivated. Your personal data will be handled in accordance with our Privacy Policy. Thumbnails stored on our servers will be deleted.

10. Changes to Terms

TrackSorter may modify these Terms at any time. Significant changes will be notified by email or through the application at least 30 days before they take effect. Continued use of the service after the changes take effect constitutes acceptance of the new terms.

11. Governing Law and Disputes

These Terms are governed by French law. In case of dispute, the parties will endeavor to find an amicable solution. Failing that, the competent French courts will have exclusive jurisdiction over the dispute.

In accordance with the provisions of the French Consumer Code, you may use conventional mediation or any alternative dispute resolution method in case of dispute.

12. Miscellaneous Provisions

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will remain in effect. Failure to exercise any right under these Terms does not constitute a waiver of that right.
